Violation of a Restraining Order is a criminal offense, defined by General Laws Chapter 209A, Section 7. The first essential element of the crime is the existence of a restraining order in effect on the date of offense. The prosecutor must also prove that the defendant knew about the restraining order, and that the defendant violate a specific provision in the order through some act. Accidental contact may be a defense to this charge, but the fact that the person who obtained the restraining order initiated contact is not a defense.
