As with every type of case, I initially confer with the client to carefully review the facts of the civil dispute and the client’s goals. Many civil disputes can be resolved through negotiation, and sometimes a well-drafted demand letter can obtain the desired result. In other scenarios, the involved parties may agree to an efficient and relatively inexpensive means of resolving the dispute, such as mediation or arbitration. Litigation—filing a lawsuit in court—is a last resort but often necessary if negotiations fail.
Litigation is costly and can take a long time—sometimes several years—to resolve. I always confer carefully with clients to assess their goals before recommending litigation.
